General Terms and Conditions for Bachelor’s study programme
1. Conduct of the study programme
1.1. Study programme designation and degree qualification
IU Internationale Hochschule GmbH (hereinafter referred to as: IU), the sponsor of IU International University of Applied Sciences, undertakes to implement the online learning programme (hereinafter: programme) at IU International University of Applied Sciences mentioned on page 1 of the study contract (hereinafter: contract) in accordance with the respective valid study and examination regulations of IU International University of Applied Sciences. For participants and thus, also for the periods in which the participant does not yet have official student status, the respectively valid study and examination regulations of the underlying study programme apply. The contract is concluded with the electronic confirmation of acceptance by IU.
Upon successful completion of the online study programme, the student acquires the academic title according to the respective study and examination regulations valid for the chosen study programme. The content of the courses offered, as well as the period of time allocated for each of them, result from the module handbook with curriculum, which is made available to the student in a suitable form.
IU points out that, in the case of newly introduced study programmes, there may be a restriction on the availability of study content from higher subject semesters; likewise, in the case of newly introduced study programmes, a student’s free choice regarding the sequence of study content cannot always be guaranteed. Notwithstanding this, IU ensures that the contents of the study programme in question can be completed within the underlying standard period of study.
IU would like to point out that the successful completion of the study programmes "B.A. Architektur" and "B.A. Innenarchitektur" currently does not entitle the holder to register directly with the respective Chamber of Architects, and the professional title of "architect" or "interior architect" may currently not be used on the basis of the successful completion of said study programme. In this context, the IU expressly does not guarantee any subsequent professional admission following the study programme.
Furthermore, it is pointed out that certain study programs have compulsory presence and practice parts and that these study programs can therefore not take place exclusively within the framework of distance learning. Further information on this can be found in the respective valid module handbooks and is specified in the respective practice module-related examination guidelines.
1.2 Amendment of curricula
IU has the right to amend the curricula insofar as this is reasonable for the student and in accordance with the educational objective of the study programme.
1.3 Admission to the study programme
(1) Enrolment and admission to the study programme are carried out in accordance with the requirements of the General Admission and Enrolment Regulations (AZE) in force at the time and the applicable regulations of IU.
(2) Applicants seeking admission via professional qualification for a non-subject-related study programme shall begin their study programme with the status of participant and only become enrolled students once they have successfully completed the required courses in accordance with the General Examination Regulations (APO) as well as the Regulations for Examinations for Admission to Bachelor's and Master's Degree Programmes (OZBM) applicable at the time. This must be done within a period of twelve months; otherwise, the contract ends without requiring termination. With regard to the extra-curricular admission courses, Clause 1.3 (5) and Clause 2.1 shall apply in derogation of this regulation.
(3) Applicants are admitted according to the AZE insofar as this applies in accordance with the Entrance Examination Regulation and if applicable can take the entrance examination with participant status and only become matriculated students after successful completion of the courses prescribed according to the APO and the Entrance Examination Regulations (Zugangsprüfungsordnung). The Bachelor entrance examination must be successfully passed within twelve months; otherwise, the contract ends with the expiry of twelve months without the need for termination. With status participant, the applicant will not gain ECTS-credits until the status as student is reached.
(4) For part-time students who have qualified for a trial period of study in accordance with the AZE, the maximum duration of the trial period of study of two semesters is extended proportionally depending on the chosen time model.
(5) In addition to the existence of to the general university entrance qualification as a special admission requirement, applicants for individual design courses, e.g. in design, must take and pass a design aptitude test In accordance with the OZBM in the currently valid version before the start of the contract in order to be admitted to the desired course. Applicants will only be granted the status of enrolled students if they have successfully passed the aptitude test in accordance with the OZBM in its currently valid version and if the other requirements for admission to the university have been met and proven. The creative aptitude test must be passed within twelve months from the beginning of the test and must be proven in the form specified in the OZBM, otherwise this contract will not come into effect. Applicants who have been granted general university admission on the basis of their professional qualifications may only commence the trial studies according to the AZE in the currently valid version or the entrance examination according to the OZBM in the currently valid version after successfully completing the creative aptitude test.
(6) The regulations of this contract also apply to participants, even if the designation "student" is used.
1.4 Student status
Participants are granted official student status when they have successfully completed all admission requirements and have submitted all required documents in the required form by the AZE.
2. Contract term
2.1 Duration of the contract
The standard period of study related to the chosen study program is based on the details on page 1 of this contract, and in the case of a postponement of the study start date, on the terms of the corresponding supplementary agreement. The time model corresponds to the general standard period of study. The contract is generally concluded for an indefinite period of time, should the intended degree not be attainable within the specified time frame (time model).
This contract is generally concluded for an indefinite period of time. It begins at the time specified on page 1, unless otherwise agreed, but at the earliest upon receipt of the access data to the Campus Management System. The contract ends after the agreed standard period of study without the need for termination, as long as the student provides all necessary proof of performance by this time. If the student does not provide all necessary proof of performance within the agreed standard period of study, this contract will be extended in accordance with the provisions in 2.2. of this contract.
If the participant is required to attend and pass extracurricular admissions courses, such as, but not limited to, admissions courses, bridge courses, the design aptitude test or the study aptitude test in accordance with the OZBM, in order to obtain part or all of the university entrance qualification, the contract shall begin, in deviation from what was previously agreed, on the date stated on page 1, unless otherwise agreed, but no earlier than the date notified to the Participant in the confirmation of admission to the study program: The participant will be informed of this in the IU's confirmation of admission to the study program.
The participant will receive the Confirmation of Admission to Studies within fourteen days from the date of notification of passing the relevant extracurricular admission courses in the Campus Management System. The exact start date of the contract will be communicated to the participant in the letter confirming admission to the study program and will be within fourteen days of the announcement of the passing of the respective extracurricular admission courses, unless a later start date has been chosen.
A participant who is unable to provide the documents verifying the possession of a higher education entrance qualification and the documents for admission to the chosen study programme in accordance with the AZE valid at the time in the required form before the start of the contract will be granted temporary access to the Course content at a charge, however, he:she is not entitled to acquire ECTS credits and/or take part in examinations during this period. The agreed standard period of study is not changed by the subsequent submission of documents. However, enrolment to receive official student status will not occur until all admission requirements have been successfully met and all required documents have been submitted in the required form in accordance with the AZE.
The participant is obliged to submit the documents to IU in the required form within six months after the start of the contract specified in 2.1. If this is not done in time and/or if the participant does not meet the necessary admission requirements for the study programme in accordance with the provisions of the AZE and/or other regulations of IU International University of Applied Sciences in force at that time, the contract shall terminate at the end of the sixth month without the need for termination and without the achievement of a degree, irrespective of whether the special admission requirements pursuant to sections 1.3 (2), (3) and (5) have been or could still be fulfilled.
2.2. Contract extension due to lack of performance records
If the student does not provide all the necessary proof of performance within agreed standard period of study, the contract is automatically extended free of charge for a maximum of twelve months. If the assumed standard period of study is reduced due to the recognition of prior achievements and qualifications within the framework of the study and examination regulations, the contract is automatically extended free of charge by a maximum of twelve months from the premature termination date of the standard period of study agreed in principle due to the reduction. During this period, all services can continue to be used and examination services can be provided without incurring further costs, provided that the monthly instalments payable in accordance with page 1 have already been paid in full at this time.
If the student does not provide all necessary proof of performance within the free contract extension, the contract will be automatically extended for an indefinite period of time with costs following the free extension. For the fee-based extension of the duration of the contract in accordance with this section, the tuition fees applicable at that time must be paid in return for the continued use of IU’s facilities and services.
IU reserves the right to adjust (increase or decrease) the tuition fees to the then current tuition fee level in the event of an extension following the agreed standard period of study and the free extension period. In the event of a fee-based extension of the term, the tuition fees that were valid at the time of commencement of studies will not automatically be applied. IU will inform the student in advance in text form about the fees to be paid during the fee-based extension.
2.3 Ordinary termination of the contract
Until the end of the first five months the contract can be terminated with a notice period of one month to the end of a full month in relation to the beginning of the contract.
After the end of the first five months, the contract may be terminated at any time with three months' notice to the end of a full month in relation to the start of the contract.
During the free of charge and fee-based extension according to 2.2. after expiration of the standard period of study according to 2.1./2.2. the contract can be terminated at any time with a notice period of one month.
Notice of termination must be given in text form (e.g. by termination in the Campus Management System, termination by form on the IU Website or by e-mail).
2.4 Extraordinary termination of the contract
The right to extraordinary termination for good cause remains unaffected. Important reasons on the part of the student entitling him:her to extraordinary termination exist, in particular, in the event of appropriately proven unexpected occurrence of unemployment, life-threatening illnesses and the death of the student. A change of study programme, relocation, failed exams, financial or family reasons do not generally justify extraordinary termination. If admission to the study programme lapses, is revoked or withdrawn after conclusion of the contract, the student may terminate the contract within two weeks without observing a notice period.
On the part of IU, important reasons entitling the IU to extraordinary termination may exist, in particular, in case of tuition fees not paid on time, violations of the study and examination regulations of IU International University of Applied Sciences, in case of criminal acts of the student to the detriment of IU, if the student does not meet all the admission requirements for the selected programme and/or cannot provide evidence of these in the required form in accordance with the AZE or if it is foreseeable that a necessary (re)accreditation or approval of a study programme will not be granted.
2.5 Leave of absence
In cases of illness or other proven personal reasons that prevent the student from continuing with their studies, the student may apply for a leave of absence for a period of six months. In principle, a leave of absence can be granted at the earliest at the start of the second semester, i.e. six months after the start of studies.
The mutual rights and obligations of the contract shall be suspended for the period of the leave of absence. The obligation to pay the entire tuition fees according to section 3. shall remain in force even if the student is on leave of absence. If the student is granted a leave of absence for a period of six months, the monthly instalments stipulated on page 1 of this contract shall be paid over and above the standard period of study agreed on page 1 until the total sum of the monthly instalments payable under page 1 has been paid in full.
The application for a leave of absence for a period of six months must be made in text form no later than two weeks before the desired start date at the start of a full month in relation to the start date of the contract. The contract cannot be terminated during the period of a leave of absence that has been granted. When applying for a leave of absence, the "Leaflet on Leave of Absence" and/or the "Leaflet on Leave of Absence due to Maternity and/or Paternity Leave" will become part of this contract. Persons who only enjoy participant status cannot apply for a leave of absence.
2.6. Failure to pass necessary examinations
In the event that the student ultimately fails an examination required for the successful completion of the study programme, the contract shall end without the need for termination upon final failure. In this case, the student will be ex-matriculated if official student status was reached at that time.
3. Tuition fees
3.1 Cost models per time variant
The total cost of the chosen study programme depends on the chosen time model. In the event of a change of time model during the study programme, the tuition fees applicable to the new time model at the time of application will be taken as a basis.
3.2. Tuition fees for the study program
The total costs for the chosen study programme related to the standard period of study are stated on page 1 of the contract and are payable in full regardless of the actual period time spent in the study program upon successful completion of the study program within the standard period of study or before, unless the contract is terminated prematurely without successful completion of the study program.
3.3 Method of payment and payment deadline
Tuition fees are payable monthly and are due in arrears at the end of each month. With an existing SEPA direct debit mandate or authorization to collect fees by credit card, the tuition fees will be debited retrospectively at the end of each month. Otherwise, students are obliged to transfer the tuition fees to IU in arrears at the end of each month. Tuition fees shall be paid for the first time after expiry of the withdrawal period. The graduation fee is due upon registration for the final examination (colloquium). It must either be transferred by the student to the IU within ten days of the due date or, if a SEPA direct debit mandate or authorization to debit by credit card has been issued, it will be collected by IU. Without full payment of the graduation fee, the student cannot graduate. If the student wishes to take his:her final examination (colloquium) before the end of the agreed standard period of study stipulated in Clause 2.1, the tuition fees still outstanding until the regular end of the study programme must be paid in full before the date of the colloquium. Changes regarding the amount of tuition fees may result from discount promotions in effect at the time of registration.
3.4 Reduction of tuition fees through recognition of prior achievements
Upon application, prior knowledge and qualifications can be recognized within the framework of the study and examination regulations. This recognition may lead to a change in the duration of study and to a reduction in tuition fees. If the standard period of study is reduced due to the recognition of prior knowledge and qualifications within the framework of the study and examination regulations, the student will be informed of the changed standard period of study by a notification of recognition (Anerkennungsbescheid).
If the application for recognition of prior knowledge and qualifications is submitted before the start of the study program as defined in section 2.1. or within one month after the start of the study program (end of trial month), the tuition fees per recognized ECTS credit are reduced as follows:
- For prior knowledge and qualifications acquired and recognised at IU International University of Applied Sciences in a completed programme, the total amount of tuition fees is reduced by a one-time EUR 90.00 per recognised ECTS credit for the standard period of study.
- For externally acquired and recognised prior knowledge and qualifications, the total amount of the tuition fees is reduced by a one-time EUR 30.00 per recognised ECTS credit for the standard period of study.
The number of instalments to be paid and/or the amount of the final instalment is reduced, the instalment amount on page 1 remains unchanged. In the case of an application for recognition of prior knowledge and qualifications after the trial month, no reduction in tuition fees will be made. The applicant will be informed of the number of ECTS credits recognised and the reduction in tuition fees by means of a notification of recognition (Anerkennungsbescheid).
3.5 Recognition of prior learning for professional online study programmes
For vocational online study programmes that require mandatory specific vocational training in the subject of the online study programme (e.g. Physiotherapie B.A., Ergotherapie B.Sc. and others), prior knowledge and qualifications are recognised within the framework of the study and examination regulations without application. The student may neither object to this blanket recognition nor take the courses recognised under this blanket recognition at IU International University of Applied Sciences.
This recognition leads to a change in the duration of studies, the duration of the contract and a reduction in tuition fees, which is already taken into account on page 1. In addition, 3.4. of the contractual provisions shall apply.
4. Student obligations
4.1 Payment of tuition fees
If the tuition fees are not paid by the due date, IU is entitled to charge the student for any fees incurred. Irrespective of this, IU is entitled to terminate the contract extraordinary without notice if the student is in arrears with the payment of tuition fees.
If the student decides to make an advance payment before the start of the studies, he:she is only entitled to the granting of an advance payment discount if the payment amount has been received in the IU account by the expiry of the withdrawal period.
4.2. Examinations
If the student has to repeat an examination because of attempted cheating or plagiarism, additional fees of EUR 300.00 will be charged for each examination to be repeated. Within 24 months of taking the corresponding course, the student must complete the corresponding examination specified in the module handbook, but at least the first examination attempt. If the student does not complete this examination or the first examination attempt within 24 months of taking the course, all learning assessments completed up to that point are forfeited with the consequence that they must be completed again within twelve months and the course must be taken again at a charge.
4.3. Completion of coursework by means of online tools
The completion of course work in certain modules or programmes can sometimes only be done through the use of online tools, which also require data processing outside the EU. The details on data processing are explained in separate information sheets.
The student is aware that in order to ensure the smooth running of online examinations, a knowledge of English to a small extent is necessary, as communication with the proctors (examination invigilators) is only possible in English.
4.4 Checking using plagiarism software
The student is obliged to provide an electronic version of his:her examination paper in a format that can be electronically copied and read (e.g. DOC, DOCX, PDF, RTF) free of all personal data (without cover sheet, personal declarations, dedications, signature, etc.) to enable the IU to check his:her examination paper using plagiarism software. The student grants the IU and third parties specifically commissioned by the IU the right to use the examination paper for this purpose.
4.5 Preservation of copyright
All study content and media are protected by copyright. Any use in cases other than those permitted by contract is not permitted and requires the prior written consent of the copyright holder. This applies in particular to making them publicly available via the Internet, copying them and passing them on to third parties. It is permitted to save and print out the study content and media for personal purposes.
4.6 Further obligations
The student acknowledges the currently valid General Examination Regulations as well as the Study and Examination Regulations (APO) for the degree programme of IU International University of Applied Sciences named on page 1 of this contract, the IU Library Usage Regulations and the guidelines for online examinations and online presentations as binding for him:herself.
4.7 Additional costs
For the implementation of some courses of study, the purchase of certain technical equipment or other materials and/or the participation in certain excursions by the students is necessary. The purchase of this equipment and materials and costs for excursions are not included in the tuition fees. The respective additional costs can be found on the IU website.
5. Virtual campus and digital learning material
Central learning processes in the degree programme as well as the organisation of studies are internet-based via the virtual campus of IU International University of Applied Sciences. The provision of the necessary technical equipment is not included in the tuition fees. The student is solely responsible for providing technical study equipment (hardware and software) that meets the requirements of IU. The student is obliged to inform him/herself independently whether the online tools and other technologies used by IU which are necessary for the execution of this contract are available in his:her region. An overview of the necessary online tools and the required technical study equipment (software and hardware) are listed on the website (LINK: https://www.iu-fernstudium.de/en/advice-and-faq/faqs/).
The virtual campus of IU International University of Applied Sciences is password protected. The access data is communicated to the student at the beginning of the study programme and he:she guarantees not to pass this data on to third parties and not to allow unauthorised third parties to access the virtual campus or the learning materials of the study programme.
6. Right of withdrawal
The student has the right to withdraw from this contract within one month without giving reasons. The withdrawal period is one month from the day on which the student receives access to the learning material. In order to exercise the right of withdrawal, the student must inform IU Internationale Hochschule GmbH of his:her decision to withdraw from this contract by means of a clear declaration (e.g. a letter sent by post or an e-mail). He:she may use the model withdrawal form, which is made available to the student digitally in the Campus Management System, for this purpose, but it is not mandatory. To comply with the withdrawal period, it is sufficient that he:she sends the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.
IU grants the student one month, which is not charged, if the student decides not to continue the studies within the withdrawal period. If the student continues his:her studies and does not exercise his:her right of withdrawal, this first month shall be deemed to be a regular study period for which a fee is charged.
7. Data protection
The details of the processing of personal data and the rights of the student in this context are explained in the separate information letter on data protection, which is made available to students on the homepage of the IU distance learning programme. In order to implement the contract, IU uses software from various providers through which personal data is also processed outside the European Union.
8. Liability of IU
IU is liable for damages based on an intentional or grossly negligent breach of duty by one of its legal representatives or vicarious agents. Furthermore, IU is liable for damages resulting from injury to life, body or health that are based on an intentional or negligent breach of duty by one of its legal representatives or vicarious agents. Otherwise, liability for damages based on a simple or slightly negligent breach of duty or a simple or slightly negligent tortious act committed by a legal representative or vicarious agent is excluded, unless essential obligations are breached, compliance with which is required to achieve the purpose of the contract, or which arise from the justified use of special trust. In these exceptional cases, liability is limited to compensation for foreseeable damage.
9. Place of jurisdiction and final provisions
German law shall apply to all claims arising from and in connection with this contract. In the event that the student moves his:her residence or habitual abode outside the Federal Republic of Germany after conclusion of the contract or if his:her residence or habitual abode is unknown at the time the action is brought, the following is agreed: For all disputes arising from or in connection with this contract, the jurisdiction of the German court responsible for the registered office of IU is agreed.
IU does not participate in dispute resolution proceedings within the meaning of the Consumer Dispute Resolution Act (VSBG).
In accordance with the legal requirements, IU has provided a private guarantee, which guarantees all students the completion of their studies, regardless of the economic situation of the institution. For legal reasons, we would like to point out that the Free State of Thuringia does not provide any additional security.
There are no ancillary agreements to this contract. Amendments or supplements to this contract must be made in text form to be effective. The amendment or supplement to this provision itself shall also require text form. Should individual or several provisions of this contract be or become invalid, the validity of the remaining provisions shall remain unaffected. In the event of a loophole in this contract, a provision shall be found which otherwise corresponds to the meaning, purpose and economic content of the contract.

Applicants are not enrolled until they have met all the necessary admission requirements and passed the required admission courses. If further qualification is required, e.g. work experience, students may be registered in Participant status and move to Student status as soon as they can submit the required documentation. The Master's access examination must be successfully passed within twelve months, otherwise this contract ends automatically after twelve months without the need for termination. With regard to the extra-curricular admission courses, clause 1.3 (5) and Clause 2.1 shall apply in derogation of this regulation. Applicants lacking professional experience can be registered as participants in the "Early Admission Master Programme". No ECTS credits can yet be acquired through examination achievements taken as a participant in the entrance examination, but these will be fully recognised as part of the degree programme when student status is achieved.
(3) In addition to to the existence of the general university entrance qualification as a special admission requirement, applicants for individual design courses, e.g. in the subject area of design, must take and pass a design aptitude test in accordance with the OZBM as amended prior to the start of the contract in order to be admitted to the desired course. Applicants will not be granted the status of enrolled student until they have successfully passed the aptitude test in accordance with the OZBM as amended from time to time, and the other requirements for admission to the university have been met and verified. The creative aptitude test must be successfully completed within twelve months from the beginning of the test and must be proven in the form specified in the OZBM, otherwise this contract will not come into effect.
Applicants who have to pass the master's entrance qualification or master's aptitude test according to clause 1.3 (2) before being admitted to the program can only start the master's entrance qualification or master's aptitude test according to the OZBM in the currently valid version after successfully passing the design aptitude test.
(4) The regulations of this contract also apply to participants, even if the designation "student" is used.
1.4 Student status
Participants receive official student status if they have successfully fulfilled all admission requirements and submitted all required documents in the required form according to the AZE. The same applies to Master applicants with entrance examination, admission courses or/and missing documents, e.g. professional experience (if required for the programme).

If the participant is required to attend and pass extracurricular admissions courses, such as, but not limited to, admissions courses, bridge courses, the design aptitude test or the study aptitude test in accordance with the OZBM, in order to obtain part or all of the university entrance qualification, the contract shall begin, in deviation from what was previously agreed, on the date stated on page 1, unless otherwise agreed, but no earlier than the date notified to the Participant in the confirmation of admission to the study program: The participant will be informed of this in the IU's confirmation of admission to the study program.
The participant will receive the Confirmation of Admission to the Study Program within fourteen days from the date of notification of passing the relevant extracurricular admission courses in the Campus Management System. The exact start date of the contract will be communicated to the participant in the letter confirming admission to the study program and will be within fourteen days of the announcement of passing the relevant extracurricular admission courses, unless a later start date has been chosen.
A participant who cannot provide the documents for proof of higher education entrance qualification and the documents for admission to the chosen degree programme according to the respective valid AZE in the required form before the start of the contract, will be granted temporary access to the course content at a charge, however, he:she is not entitled to acquire ECTS-credits and/or take part in examinations during this period. The agreed standard period of study specified on page 1 is not changed by the subsequent submission of the documents. However, enrolment to obtain official student status will only take place once all admission requirements have been successfully met and all required documents have been submitted in the required form in accordance with the AZE. This may also apply to Master's applicants who lack professional experience.
The participant is obliged to submit the documents to the IU in the required form within six months after the start of the contract specified in 2.1. If this is not done in due time and/or if the participant does not fulfil the necessary admission requirements for the study programme in accordance with the provisions of the AZE and/or other regulations of IU International University of Applied Sciences in force at that time, the study contract shall end at the end of the sixth month without the need for termination and without the achievement of a degree, irrespective of whether the special admission requirements pursuant to sections 1.3 (2) and (3) have been or could still be fulfilled.
2.2. Contract extension due to lack of performance records
If the student does not provide all the necessary proof of performance within the agreed standard period of study, the contract is automatically extended free of charge for a maximum of twelve months. If the assumed standard period of study is reduced due to the recognition of prior achievements and qualifications within the framework of the study and examination regulations, the contract is automatically extended free of charge by a maximum of twelve months from the premature termination date of the standard period of study due to the reduction. During this period, all services can continue to be used and examination services can be provided without incurring further costs, provided that the monthly instalments payable in accordance with page 1 have already been paid in full at this time.
If the student does not provide all necessary proof of performance within the free contract extension, the contract will be automatically extended for an indefinite period of time with costs following the free extension. For the fee-based extension of the duration of the contract in accordance with this section, the tuition fees applicable at that time must be paid in return for the continued use of IU’s facilities and services.
IU reserves the right to adjust (increase or decrease) the tuition fees to the then current tuition fee level in the event of an extension following the agreed standard period of study and the free extension period. In the event of a fee-based extension of the term, the tuition fees that were valid at the time of commencement of studies will not automatically be applied. IU will inform the student in advance in text form about the fees to be paid during the fee-based extension.
2.3 Ordinary termination of the contract
Until the end of the first five months the contract can be terminated with a notice period of one month to the end of a full month in relation to the beginning of the contract.
After the end of the first five months, the contract may be terminated at any time with three months' notice to the end of a full month in relation to the start of the contract.
During the free of charge and fee-based extension according to 2.2. after expiration of the standard period of study according to 2.1./2.2. the contract can be terminated at any time with a notice period of one month.
Notice of termination must be given in text form (e.g. by termination in the Campus Management System, termination by form on the IU Website or by e-mail).
2.4 Extraordinary termination of the contract
The right to extraordinary termination for good cause remains unaffected. Important reasons on the part of the student entitling him:her to extraordinary termination exist, in particular, in the event of appropriately proven unexpected occurrence of unemployment, life-threatening illnesses and the death of the student. A change of study programme, relocation, failed exams, financial or family reasons do not generally justify extraordinary termination. If admission to the study programme lapses, is revoked or withdrawn after conclusion of the contract, the student may terminate the contract within two weeks without observing a notice period.
On the part of IU, important reasons entitling the IU to extraordinary termination may exist, in particular, in case of tuition fees not paid on time, violations of the study and examination regulations of IU International University of Applied Sciences, in case of criminal acts of the student to the detriment of IU, if the participant does not meet all the admission requirements for the selected programme and/or cannot provide evidence of these in the required form in accordance with the AZE or if it is foreseeable that a necessary (re)accreditation or approval of a study programme will not be granted.
2.5 Leave of absence
In cases of illness or other proven personal reasons that prevent the student from continuing with their studies, the student may apply for a leave of absence for a period of six months. In principle, a leave of absence can be granted at the earliest at the start of the second semester, i.e. six months after the start of studies.
The mutual rights and obligations of the contract shall be suspended for the period of the leave of absence. The obligation to pay the entire tuition fees according to section 3.2. shall remain in force even if the student is on leave of absence. If the student is granted a leave of absence for a period of six months, the monthly instalments stipulated on page 1 of this contract shall be paid over and above the standard period of study agreed on page 1 until the total sum of the monthly instalments payable under page 1 has been paid in full.
The application for a leave of absence for a period of six months must be made in text form no later than two weeks before the desired start date at the start of a full month in relation to the start date of the contract. The study contract cannot be terminated during the period of a leave of absence that has been granted. When applying for a leave of absence, the "Leaflet on Leave of Absence" and/or the "Leaflet on Leave of Absence due to Maternity and/or Paternity Leave" will become part of this contract.
Persons who only enjoy participant status cannot apply for a leave of absence. Only during the "Early Admission Master Programme" can the participant apply for a leave of absence of a maximum of one year in total (two times of six months each), regardless of whether the leave of absence is taken consecutively or not. A leave of absence beyond this period is not possible during this programme.
2.6. failure to pass necessary examinations
In the event that the student ultimately fails an examination required for the successful completion of the study programme, the contract shall end without the need for termination upon final failure. In this case, the student will be ex-matriculated if official student status was reached at that time.
3. Tuition fees
3.1 Cost models per time variant
The total cost of the chosen study programme depends on the chosen time model. In the event of a change of time model during the study programme, the tuition fees applicable to the new time model at the time of application will be taken as a basis.
3.2. Tuition fees for the study program
The total costs for the chosen study programme related to the standard period of study are stated on page 1 of the contract and are payable in full regardless of the actual period time spent in the study program upon successful completion of the study program within the standard period of study or before, unless the contract is terminated prematurely without successful completion of the study program.
3.3 Method of payment and payment deadline
Tuition fees are payable monthly and are due in arrears at the end of each month. With an existing SEPA direct debit mandate or authorization to collect fees by credit card, the tuition fees will be debited retrospectively at the end of each month. Otherwise, students are obliged to transfer the tuition fees to IU in arrears at the end of each month. Tuition fees shall be paid for the first time after expiry of the withdrawal period. The graduation fee is due upon registration for the final examination (colloquium). It must either be transferred by the student to the IU within ten days of the due date or, if a SEPA direct debit mandate or authorization to debit by credit card has been issued, it will be collected by IU. Without full payment of the graduation fee, the student cannot graduate. If the student wishes to take his:her final examination (colloquium) before the end of the standard period of study stipulated in Clause 2.1, the tuition fees still outstanding until the regular end of the study programme must be paid in full before the date of the colloquium. Changes regarding the amount of tuition fees may result from discount promotions in effect at the time of registration.
3.4 Reduction of tuition fees through recognition of prior achievements
Upon application, prior knowledge and qualifications can be recognised within the framework of the study and examination regulations. This recognition may lead to a change in the duration of studies, as well as the duration of the contract and a reduction in tuition fees. If the standard period of study is reduced due to the recognition of prior knowledge and qualifications within the framework of the study and examination regulations, the student will be informed of the changed standard period of study by means of a notice of recognition (Anerkennungsbescheid).
If the application for recognition of prior knowledge and qualifications is submitted before the start of the study programme as specified in No. 2.1. or within one month after the start of the study programme (end of trial month), the tuition fees per recognised ECTS credit are reduced as follows:
- For prior knowledge and qualifications acquired and recognised at IU International University of Applied Sciences in a completed programme, the total amount of tuition fees is reduced by a one-time EUR 90.00 per recognised ECTS credit for the standard period of study.
- For externally acquired and recognised prior knowledge and qualifications, the total amount of the tuition fees is reduced by a one-time EUR 30.00 per recognised ECTS credit for the standard period of study.
The number of instalments to be paid and/or the amount of the final instalment is reduced, the instalment amount on page 1 remains unchanged. In the case of an application for recognition of prior knowledge and qualifications after the trial month, no reduction in tuition fees will be made. The applicant will be informed of the number of ECTS credits recognised and the reduction in tuition fees by means of a notification of recognition (Anerkennungsbescheid).
4. Student obligations
4.1 Payment of tuition fees
If the tuition fees are not paid by the due date, IU is entitled to charge the student for any fees incurred. Irrespective of this, IU is entitled to terminate the contract extraordinary without notice if the student is in arrears with the payment of tuition fees. If the student decides to make an advance payment before the start of the studies, he:she is only entitled to the granting of an advance payment discount if the payment amount has been received in the IU account by the expiry of the withdrawal period.
4.2. Examinations
If the student has to repeat an examination because of attempted cheating or plagiarism, additional fees of EUR 300.00 will be charged for each examination to be repeated. Within 24 months of taking the corresponding course, the student must complete the corresponding examination specified in the module handbook, but at least the first examination attempt. If the student does not complete this examination or the first examination attempt within 24 months of taking the course, all learning assessments completed up to that point are forfeited with the consequence that they must be completed again within twelve months and the course must be taken again at a charge.
4.3. Completion of coursework by means of online tools
The completion of course work in certain modules or programmes can sometimes only be done through the use of online tools, which also require data processing outside the EU. The details on data processing are explained in separate information sheets.
The student is aware that in order to ensure the smooth running of online examinations, a knowledge of English to a small extent is necessary, as communication with the proctors (examination invigilators) is only possible in English.
4.4 Checking using plagiarism software
The student is obliged to provide an electronic version of his:her examination paper in a format that can be electronically copied and read (e.g. DOC, DOCX, PDF, RTF) free of all personal data (without cover sheet, personal declarations, dedications, signature, etc.) to enable the IU to check his:her examination paper using plagiarism software. The student grants the IU and third parties specifically commissioned by the IU the right to use the examination paper for this purpose.
4.5 Preservation of copyright
All study content and media are protected by copyright. Any use in cases other than those permitted by contract is not permitted and requires the prior written consent of the copyright holder. This applies in particular to making them publicly available via the Internet, copying them and passing them on to third parties. It is permitted to save and print out the study content and media for personal purposes.
4.6 Further obligations
The student acknowledges the currently valid General Examination Regulations as well as the Study and Examination Regulations (APO) for the degree programme of IU International University of Applied Sciences named on page 1 of this contract, the IU Library Usage Regulations and the guidelines for online examinations and online presentations as binding for him/herself.
4.7 Additional costs
For the implementation of some degree programmes, the acquisition of certain technical equipment or other materials and/or participation in certain excursions by the student is necessary. The purchase of this equipment and materials and costs for excursions are not included in the tuition fees. The respective additional costs can be viewed on the IU website.
5. Virtual campus and digital learning material
Central learning processes in the degree programme as well as the organisation of studies are internet-based via the virtual campus of IU International University of Applied Sciences. The provision of the necessary technical equipment is not included in the tuition fees. The student is solely responsible for providing technical study equipment (hardware and software) that meets the requirements of IU. The student is obliged to inform him/herself independently whether the online tools and other technologies used by IU, which are necessary for the execution of this contract, are available in his:her region. An overview of the necessary online tools and the required technical study equipment (software and hardware) are listed on the website (LINK: https://www.iu-fernstudium.de/en/advice-and-faq/faqs/).
The virtual campus of the IU International University of Applied Sciences is password-protected. The access data is communicated to the student at the beginning of the study programme and he:she guarantees not to pass this data on to third parties and not to allow unauthorised third parties to access the virtual campus or the learning materials of the study programme.
6. Right of withdrawal
The student has the right to withdraw from this contract within one month without giving reasons. The withdrawal period is one month from the day on which the student receives access to the learning material. In order to exercise the right of withdrawal, the student must inform IU Internationale Hochschule GmbH of his:her decision to withdraw from this contract by means of a clear declaration (e.g. a letter sent by post or an e-mail). He:she may use the model withdrawal form, which is made available to the student digitally in the Campus Management System, for this purpose, but it is not mandatory. To comply with the withdrawal period, it is sufficient that he:she sends the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.
IU grants the student one month, which is not charged, if the student decides not to continue the studies within the withdrawal period. If the student continues his:her studies and does not exercise his:her right of withdrawal, this first month shall be deemed to be a regular study period for which a fee is charged.
7. Data protection
The details of the processing of personal data and the rights of the student in this context are explained in the separate information letter on data protection, which is made available to students on the homepage of the IU distance learning programme. In order to implement the contract, IU uses software from various providers through which personal data is also processed outside the European Union.
8. Liability of IU
IU is liable for damages based on an intentional or grossly negligent breach of duty by one of its legal representatives or vicarious agents. Furthermore, IU is liable for damages resulting from injury to life, body or health that are based on an intentional or negligent breach of duty by one of its legal representatives or vicarious agents. Otherwise, liability for damages based on a simple or slightly negligent breach of duty or a simple or slightly negligent tortious act committed by a legal representative or vicarious agent is excluded, unless essential obligations are breached, compliance with which is required to achieve the purpose of the contract, or which arise from the justified use of special trust. In these exceptional cases, liability is limited to compensation for foreseeable damage.
9. Place of jurisdiction and final provisions
German law shall apply to all claims arising from and in connection with this contract. In the event that the student moves his or her residence or habitual abode outside the Federal Republic of Germany after conclusion of the contract or if his or her residence or habitual abode is unknown at the time the action is brought, the following is agreed: For all disputes arising from or in connection with this contract, the jurisdiction of the German court responsible for the registered office of IU is agreed.
IU does not participate in dispute resolution proceedings within the meaning of the Consumer Dispute Resolution Act (VSBG).
In accordance with the legal requirements, IU has provided a private guarantee, which guarantees all students the completion of their studies, regardless of the economic situation of the institution. For legal reasons, we would like to point out that the Free State of Thuringia does not provide any additional security.
There are no ancillary agreements to this contract. Amendments or supplements to this contract must be made in text form to be effective. The amendment or supplement to this provision itself shall also require text form. Should individual or several provisions of this contract be or become invalid, the validity of the remaining provisions shall remain unaffected. In the event of a loophole in this contract, a provision shall be found which otherwise corresponds to the meaning, purpose and economic content of the contract.
General Terms and Conditions further education programmes
1. Conduct of the programme
1.1. Programme name and title after graduation
IU Internationale Hochschule GmbH (hereinafter: IU), the sponsor of IU International University of Applied Sciences, undertakes to implement the distance learning programme (hereinafter: programme) at IU International University of Applied Sciences mentioned on page 1 of the Distance Learning Contract (hereinafter: contract) in accordance with the respective valid study and examination regulations of the underlying study programme of IU International University of Applied Sciences. For participants, the valid study and examination regulations of the underlying study programme apply accordingly.The contract is concluded with the electronic confirmation of acceptance by IU.
Upon successful completion of the programme, the participant will receive a certificate for the programme specified on page 1 of this contract. The content of the courses offered, as well as the period of time allocated for each of them, result from the module handbook with curriculum, which is made available to the participant in a suitable form.
IU points out that in the case of newly introduced programmes or newly introduced source study programmes on which the programmes are based, there may be a restriction on the availability of programme content from higher subject semesters of the underlying source study programme, likewise, in the case of newly introduced programmes or newly introduced source study programmes on which the programmes are based, the free choice of the sequence of the programme content cannot always be guaranteed. Notwithstanding this, IU ensures that the content of the relevant programme can be completed within the agreed programme period.
Furthermore, it is pointed out that certain programmes have compulsory presence and practice parts and that these programmes therefore cannot take place exclusively within the framework of distance learning. Further information on this can be found in the respective valid module manuals of the underlying source study programme and are specified in the respective practice module-related examination guidelines.
1.2. Amendment of programme schedules
IU has the right to amend programme plans insofar as this is reasonable for the participants and in accordance with the educational objective of the programme.
1.3. Admission to the programme
The admission to the programme is subject to the condition that the participant has a university entrance qualification or a completed vocational education. The prerequisite for the fulfillment of the university entrance qualification at IU International University of Applied Sciences is that the participant has the general university entrance qualification, the subject-related university entrance qualification or the advanced technical college entrance qualification, a university entrance qualification recognized as equivalent by the responsible state authorities or a corresponding professional qualification.
1.4. No student status
Participants do not acquire student status, even if they successfully meet all admission requirements and have provided proof of this in the required form.
2. Contract term
2.1. Duration of the Contract
The regular programme period related to the selected programme is based on the information on page 1 of this agreement; in the event of a postponement of the programme start, the regular programme period is based on the content of the corresponding supplementary agreement ("agreed programme period").
This contract is generally concluded for an indefinite period of time. It begins on the time specified on page 1 of this contract, unless otherwise agreed, but at the earliest upon receipt of the access data to the Campus Management System. The contract ends after the agreed programme period without the need for termination, as long as the participant provides all necessary proof of performance in relation to the selected programme by this time. If the participant does not provide all necessary proof of performance within the agreed programme period, this contract will be extended in accordance with the provisions in 2.2. of this contract.
A participant who is unable to submit the documents proving his:her university entrance qualification and the documents for admission to the selected programme in accordance with the General Admission and Enrollment Regulations (AZE) in force at the time in the required form before the start of the contract will be granted temporary access to the course content at a charge, but will not be entitled to take part in examinations during this period. The agreed programme period is not changed by the subsequent submission of the documents.
The participant is obliged to submit the documents to IU in the required form within six months after the start of the contract specified in 2.1. If this is not done in due time and/or if the participant does not fulfil the necessary admission requirements for the programme in accordance with the provisions of the AZE and/or other regulations of the IU International University of Applied Sciences in force at that time, the contract shall end at the end of the sixth month without the need for termination and without the achievement of a degree.
2.2. Contract extension due to lack of performance records
If the participant does not provide all necessary proof of performance within the agreed programme period, the contract is automatically extended free of charge for a maximum of twelve months. During this period, all services can continue to be used and examination services can be provided without incurring any further costs, provided that the monthly instalments payable in accordance with page 1 have already been paid in full at this time.
If the participant does not provide all necessary proof of performance within the free contract extension, the contract will be automatically extended for an indefinite period of time at a charge following the free extension. For the fee-based extension of the contract term under this section, the programme fees applicable at that time must be paid in return for the continued use of IU's facilities and services.
IU reserves the right to adjust (increase or decrease) the programme fees to the then current level of programme fees in the event of an extension following the agreed programme period and the free extension period. In the event of a fee-based extension of the term, the programme fees that were valid at the time of the commencement of the programme will not automatically be applied. IU will inform the participant in advance in text form about the fees to be paid during the fee-based extension.
2.3 Ordinary termination of the contract
Until the end of the first five months the contract can be terminated with a notice period of one month to the end of a full month in relation to the beginning of the contract.
After the end of the first five months, the contract may be terminated at any time with three months' notice to the end of a full month in relation to the start of the contract.
During the free of charge and fee-based extension according to 2.2. after expiration of the agreed programme period according to 2.1./2.2. the contract can be terminated at any time with a notice period of one month.
Notice of termination must be given in text form (e.g. by termination in the Campus Management System, termination by form on the IU Website or by e-mail).
2.4. Extraordinary termination of the contract
The right to extraordinary termination for good cause remains unaffected. On the part of IU, important reasons entitling the IU to extraordinary termination may exist, in particular in case of programme fees not paid on time, violations of the study and examination regulations of IU International University of Applied Sciences, in case of criminal acts of the participant to the detriment of IU, if the participant does not meet all the admission requirements for the selected programme and/or cannot provide evidence of these in the required form in accordance with the AZE or if it is foreseeable that a necessary (re)accreditation or approval of a programme will not be granted.
2.5. Failure to pass necessary examinations
In the event that the participant ultimately fails to pass the examination required for successful completion of the programme, this contract shall end without the need for termination upon final failure. In this case, the participant will be excluded from the programme.
3. Progamme fees
3.1. Cost models per time variant
The total cost of the chosen programme depends on the chosen time model. If a time model is changed during the programme, the programme fees in effect at the time of application for the new time model will be applied.
3.2. Programme fees for the program
The total costs for the chosen programme related to the agreed programme period are stated on page 1 of this contract and are payable in full regardless of the actual time spent in the programme upon successful completion of the programme within the agreed programme period or before, unless the contract is terminated prematurely without successful completion of the programme.
3.3. Method of payment and payment deadline
The programme fees are to be paid monthly and are due in arrears at the end of each month. If the participant wishes to receive his:her certificate before the end of the agreed programme period and has provided the proof of performance required for the issuance of the certificate, the programme fees still outstanding until the contractually agreed end of the programme must be paid in full. Changes regarding the amount of the programme fees may result from discount promotions at the time of registration.
4. Participant obligations

If the programme fees are not paid by the due date, IU is entitled to charge any fees incurred to the participant. Irrespective of this, IU is entitled to extraordinary termination of the contract if the participant is in arrears with the payment of the programme fees.
If the participant decides to make an advance payment before the start of the programme, he:she is only entitled to the granting of an advance payment discount if the payment amount has been received in the account of IU by the expiry of the withdrawal period.
4.2 Examinations
If the participant has to repeat an examination due to attempted cheating or plagiarism, additional fees of EUR 300.00 will be charged for each examination to be repeated. 4.3 Taking examinations using online tools
The provision of examination services in certain modules or courses can in part only take place through the use of online tools, which also require data processing outside the EU. The details of data processing are explained in separate information sheets.

The virtual campus of IU International University of Applied Sciences is password protected. The access data will be communicated to the participant at the beginning of the programme and he:she assures not to pass these data on to third parties and not to allow unauthorized third parties to access the virtual campus or the learning materials of the programme.
6. Right of withdrawal
The participant has the right to withdraw from this contract within one month without giving reasons. The withdrawal period is one month from the day on which the participant receives access to the learning material. In order to exercise the right of withdrawal, the participant must inform IU Internationale Hochschule GmbH of his:her decision to withdraw from this contract by means of a clear declaration (e.g. a letter sent by post or an e-mail). He:she may use the model withdrawal form, which is made available to the participant digitally in the Campus Management System, for this purpose, but it is not mandatory. To comply with he:she sends the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.
IU grants the participant one month, which is not charged, if the participant decides not to continue the programme within the withdrawal period. If the participant continues his:her programme and does not exercise his:her right of withdrawal, this first month shall be deemed to be a regular programme period for which a fee is charged.
7. Data protection
The details of the processing of personal data and the rights of the participant in this context are explained in the separate information letter on data protection, which is made available to participants on the homepage of the IU distance learning programme. In order to implement the contract, IU uses software from various providers through which personal data is also processed outside the European Union.
8. Liability of IU
IU is liable for damages based on an intentional or grossly negligent breach of duty by one of its legal representatives or vicarious agents. Furthermore, IU is liable for damages resulting from injury to life, body or health that are based on an intentional or negligent breach of duty by one of its legal representatives or vicarious agents. Otherwise, liability for damages based on a simple or slightly negligent breach of duty or a simple or slightly negligent tortious act committed by a legal representative or vicarious agent is excluded, unless essential obligations are breached, compliance with which is required to achieve the purpose of the contract, or which arise from the justified use of special trust. In these exceptional cases, liability is limited to compensation for foreseeable damage.
9. Place of jurisdiction and final provisions
German law shall apply to all claims arising from and in connection with this contract. In the event that the participant moves his:her residence or habitual abode outside the Federal Republic of Germany after conclusion of the contract, or if his:her residence or habitual abode is unknown at the time the action is brought, the following is agreed: For all disputes arising from or in connection with this contract, the jurisdiction of the German court responsible for the registered office of IU is agreed.
IU does not participate in any dispute resolution proceedings within the meaning of the Consumer Dispute Resolution Act (VSBG).
In accordance with the legal requirements, IU has provided a private guarantee, which guarantees all participants the completion of their programme, regardless of the economic situation of the sponsor. For legal reasons, we would like to point out that the Free State of Thuringia does not provide any additional security.
There are no ancillary agreements to this contract. Amendments or supplements to this contract must be made in text form to be effective. The amendment or addition to this provision itself shall also require text form. Should one or more provisions of this contract be or become invalid, this shall not affect the validity of the remaining provisions. In the event of a loophole in this contract, a provision shall be found which otherwise corresponds to the meaning, purpose and economic content of the contract.
