General Terms and Conditions for Bachelor’s study programme
1. Conduct of the study programme
1.1. Study programme designation and degree qualification
IU Internationale Hochschule GmbH (hereinafter referred to as: IU), the sponsor of IU International University of Applied Sciences, undertakes to implement the study programme (hereinafter: programme) at IU International University of Applied Sciences mentioned on page 1 of the study contract (hereinafter: contract) in accordance with the respective valid study and examination regulations of IU International University of Applied Sciences, which is accredited as a distance learning study programme. The contract is concluded with the electronic confirmation of acceptance by IU.
Upon successful completion of the online study programme, the student acquires the academic title according to the respective study and examination regulations valid for the chosen study programme. The content of the courses offered, as well as the period of time allocated for each of them, result from the module handbook with curriculum, which is made available to the student in a suitable form.
1.1.1. Cross-study programme information
IU points out that, in the case of newly introduced study programmes, there may be a restriction on the availability of study content from higher subject semesters. Likewise, in the case of newly introduced study programmes, a student’s free choice regarding the sequence of study content cannot always be guaranteed. Notwithstanding this, IU ensures that the contents of the relevant study programme can be completed within the underlying standard period of study.
Furthermore, it is pointed out that certain study programmes have compulsory presence and practice parts and that these study programmes can therefore not take place exclusively within the framework of distance learning. Further information on this can be found in the respective valid module handbooks and are specified in the respective practice module-related examination guidelines.
1.1.2. Study programme-specific information
(1) „B.A. Architektur” and „B.A. Innenarchitektur”
IU points out that the successful completion of the study programmes "B.A. Architektur" and "B.A. Innenarchitektur" currently does not entitle the holder to register directly with the respective Chamber of Architects, and the professional title of "architect (Architekt:in)" or "interior architect (Innenarchitekt:in)" may currently not be used on the basis of the successful completion of said study programme. In this context, the IU expressly does not guarantee any subsequent professional admission following the study programme.
(2) “B.Sc. Psychologie”
IU points out that the Bachelor's study programme “B.Sc. Psychology (180 ECTS credits)” does not meet the requirements of the new Psychotherapists Act (Gesetz über den Beruf der Psychotherapeutin und des Psychotherapeuten (Psychotherapeutengesetz – PsychThG)) and therefore, with the successful completion of this study programme - even if a corresponding Master's study programme is successfully completed afterwards - no admission to the state psychotherapeutic examination (staatliche psychotherapeutische Prüfung) is possible and therefore no licence to practise as a “psychotherapist (Psychotherapeut:in)” can be obtained (Approbation).
1.2. Amendment of curricula
IU has the right to amend the curricula insofar as this is reasonable for the student and in accordance with the educational objective of the study programme.
1.3. Admission to the study programme
(1) Enrolment and admission to the study programme are carried out in accordance with the requirements of the General Admission and Enrolment Regulations (AZE) in force at the time and the applicable regulations of IU International University of Applied Sciences.
(2) Applicants without direct university entrance qualification seeking admission via their professional qualification for a non-subject-related study programme in accordance with the Regulations for Access to Bachelor's and Master's Degree Programmes (OZBM) shall begin their study programme with the status of participant and only become enrolled students once they have successfully completed the required courses in accordance with the OZBM applicable at the time. This must be done within a period of twelve months from admission to the Bachelor’s entrance examination; otherwise, this contract ends twelve months after admission to the Bachelor’s entrance examination without requiring termination.
(3) Applicants with a successful degree from an educational institution abroad without direct university entrance qualification are admitted according to the AZE in accordance with the Admission Examination Regulations (ZugangsPO), can take the Bachelor’s entrance examination and will only be admitted to the selected study programme provided that the Bachelor’s entrance examination has been successfully completed in accordance with the ZugangsPO and the other university entrance requirements specified in Section 1.3. (1) in conjunction with the AZE have been met. The Bachelor’s entrance examination must be successfully passed within twelve months from admission to the Bachelor’s entrance examination; otherwise, this contract ends with the expiry of twelve months from admission to the Bachelor’s entrance examination without the need for termination. No ECTS-credits can be earned through examinations taken during the Bachelor’s entrance examination, but these will be fully recognised afterwards as part of the study programme.
(4) Applicants who meet the requirements set out in Section 70 (1) of the ThürHG in conjunction with the AZE shall be admitted to trial studies in accordance with the provisions of the AZE. For part-time students who have qualified for a trial period of study in accordance with the AZE, the maximum duration of the trial period of study of two semesters is extended proportionally depending on the chosen time model. If the trial study period is not successfully completed, this contract shall end upon expiry of the trial study period without the need for termination.
(5) In addition to the existence of the general university entrance qualification as a special admission requirement, applicants in design and product design study programmes must take and pass a design aptitude test in accordance with the OZBM in the currently valid version before the start of this contract in order to be admitted to the desired study programme. Applicants take part in the design aptitude test with the status of a participant and will only be granted the status of enrolled students if they have successfully passed the design aptitude test in accordance with the OZBM in its currently valid version and if the other general requirements for admission to the study programme have been met and proven. The design aptitude test must be passed within twelve months from registration for the design aptitude test and must be proven in the form specified in the OZBM, otherwise this contract will not come into effect. Applicants who have been granted general university admission on the basis of their professional qualifications may only commence the trial studies according to the AZE in the currently valid version or the entrance examination according to the OZBM in the currently valid version after successfully completing the design aptitude test.
(6) The regulations of this contract also apply to participants, even if the designation "student" is used. For participants and thus, also for the periods in which the participant does not yet have official student status, the respectively valid study and examination regulations of the underlying study programme apply.
1.4. Student status
Membership status at IU International University of Applied Sciences in the form of student status only commences once candidates
a) successfully fulfil all admission requirements for their chosen study programme, submit all necessary documents proving their university entrance qualification in accordance with the AZE in the required form, and
b) have proven that they are insured under the statutory health insurance scheme (gesetzliche Krankenversicherung) or will be insured at the start of their semester, at the earliest on the day of enrolment, or that they are not insured under the statutory health insurance scheme because they are exempt from insurance, exempt from compulsory insurance or not subject to compulsory insurance.
2. Contract term
2.1 Duration of the contract
The standard period of study related to the chosen study programme is based on the details on page 1 of this contract, and in the case of a postponement of the study start date, the standard period of study is based on the terms of the corresponding supplementary agreement. The agreed duration of study in the chosen time model on page 1 of this contract corresponds to the standard period of study for the chosen study programme.
This contract is generally concluded for an indefinite period of time.
The contract begins at the time specified on page 1 of this contract, unless otherwise agreed, but at the earliest upon receipt of the access data to the Campus Management System and upon fulfilment of the requirements set out in Section 1.3. and Section 1.4. of this contract. Fulfilment of the requirements under Section 1.4. a) of this contract is not a prerequisite for the start of the contract in cases where admission to the study programme is granted under Section 1.3. (2) of this contract (admission via examinations for admission to the study programme in accordance with the OZBM), Section 1.3. (3) of this contract (admission examination) or Section 1.3. (4) (trial study).
The contract ends after the agreed standard period of study without the need for termination, as long as the student provides all necessary proof of performance by this time. If the student does not provide all necessary proof of performance within the agreed standard period of study, this contract will be extended in accordance with the Section 2.2. of this contract.
If the participant is required to attend and pass the design aptitude test in accordance with the OZBM in order to obtain the university entrance qualification in design and product design study programmes, this contract shall begin, in deviation from what was previously agreed, on the date stated on page 1, unless otherwise agreed, but no earlier than the date notified to the participant in the confirmation of admission to the study programme: the participant will be informed of this in the IU's confirmation of admission to the study programme. The participant will receive the confirmation of admission to studies within fourteen days from the date of notification of passing the design aptitude test in the Campus Management System. The exact start date of this contract will be communicated to the participant in the letter confirming admission to the study programme and will be within fourteen days of the announcement of the passing of the design aptitude test, unless a later start date has been chosen.
2.2. Contract extension due to lack of performance records
If the student does not provide all the necessary proof of performance within agreed standard period of study, the contract is automatically extended free of charge for a maximum of twelve months. If the assumed standard period of study is reduced due to the recognition of prior achievements and qualifications within the framework of the study and examination regulations, the contract is automatically extended free of charge by a maximum of twelve months from the premature termination date of the standard period of study agreed in principle due to the reduction. During this period, all services can continue to be used and examination services can be provided without incurring further costs, provided that the monthly instalments payable in accordance with page 1 have already been paid in full at this time.
If the student does not provide all necessary proof of performance within the free contract extension, the contract will be automatically extended for an indefinite period of time at a charge following the free extension. For the fee-based extension of the duration of the contract in accordance with this Section, the tuition fees applicable at that time must be paid in return for the continued use of IU’s facilities and services.
IU reserves the right to adjust (increase or decrease) the tuition fees to the then current tuition fee level in the event of an extension following the agreed standard period of study and the free extension period. In the event of a fee-based extension of the term, the tuition fees that were valid at the time of commencement of studies will not automatically be applied. IU will inform the student in advance in text form about the fees to be paid during the fee-based extension.
2.3. Ordinary termination of the contract
Until the end of the first five months the contract can be terminated with a notice period of one month to the end of a full month in relation to the beginning of the contract.
After the end of the first five months, the contract may be terminated at any time with three months' notice to the end of a full month in relation to the beginning of the contract.
During the free of charge and fee-based extension according to Section 2.2. after expiration of the standard period of study according to Sections 2.1./2.2. the contract can be terminated at any time with a notice period of one month.
Notice of termination must be given in text form (e.g. by termination in the Campus Management System, termination by form on the IU Website or by e-mail).
In the event of termination, the student will generally be deregistered at the time this contract ends. At the request of the student, which must be made in text form, de-registration shall take place before the end of this contract. In the event of de-registration before the end of this contract, the student is obliged to pay a monthly contract fee equal to the agreed tuition fees until the end of this contract.
2.4. Extraordinary termination of the contract
The right to extraordinary termination for good cause remains unaffected. Important reasons on the part of the student entitling him:her to extraordinary termination exist, in particular, in the event of appropriately proven unexpected occurrence of unemployment, life-threatening illnesses and the death of the student. A change of study programme, relocation, failed exams, financial or family reasons do not generally justify extraordinary termination.
If the admission to the study programme lapses, is revoked or withdrawn after conclusion of the contract, the student may terminate the contract within two weeks without observing a notice period.
On the part of IU, important reasons entitling the IU to extraordinary termination may exist, in particular, in case of tuition fees not paid on time, violations of the study and examination regulations of IU International University of Applied Sciences, in case of criminal acts of the student to the detriment of IU or if it is foreseeable that a necessary (re)accreditation or approval of a study programme will not be granted.
2.5 Leave of absence
In cases of illness or other proven personal reasons that prevent the student from continuing with their studies, the student may apply for a leave of absence for a period of six months. In principle, a leave of absence can be granted at the earliest at the start of the second semester, i.e. six months after the start of studies.
The mutual rights and obligations of the contract shall be suspended for the period of the leave of absence. The obligation to pay the entire tuition fees according to Section 3. shall remain in force even if the student is on leave of absence. If the student is granted a leave of absence for a period of six months, the monthly instalments stipulated on page 1 of this contract shall be paid over and above the standard period of study agreed on page 1 until the total sum of the monthly instalments payable under page 1 has been paid in full.
The application for a leave of absence for a period of six months must be made in text form no later than two weeks before the desired start date at the start of a full month in relation to the start date of the contract. The contract cannot be terminated during the period of a leave of absence that has been granted. When applying for a leave of absence, the "Leaflet on Leave of Absence" and/or the "Leaflet on Leave of Absence due to Maternity and/or Paternity Leave" will become part of this contract.
Persons who only have participant status in accordance with Section 1.3. (2) or (5) cannot apply for a leave of absence.
2.6. Failure to pass necessary examinations
In the event that the student ultimately fails an examination required for the successful completion of the study programme, the contract shall end without the need for termination with completion of his:her personal semester, in which the final failure was achieved. In this case, the student will be de-registered at the end of his:her personal semester in which the final failure was achieved. At the request of the student, which must be made in text form, de-registration shall take place before the termination of this contract. In such cases, the contract shall end upon receipt of the request for de-registration by IU International University of Applied Sciences.
2.7 Other reasons for termination due to de-registration by IU International University of Applied Sciences
If the student's enrolment at IU International University of Applied Sciences is terminated in accordance with the reasons for de-registration specified by the AZE, this contract shall end upon de-registration without the need for termination. This provision shall only apply insofar as this contract does not provide for any deviating provisions and none of the cases specified in Sections 2.4. or 2.6. of this contract apply.
3. Tuition fees
3.1. Cost models per time variant
The total cost of the chosen study programme depends on the chosen time model. In the event of a change of time model during the study programme, the tuition fees applicable to the new time model at the time of application will be taken as a basis.
3.2. Tuition fees for the study program
The total costs for the chosen study programme related to the standard period of study are stated on page 1 of this contract and are payable in full regardless of the actual period time spent in the study programme upon successful completion of the study programme within the standard period of study or before, unless the contract is terminated prematurely without successful completion of the study programme.
3.3. Method of payment and payment deadline
Tuition fees are payable monthly and are due in arrears at the end of each month. With an existing SEPA direct debit mandate or authorisation to collect fees by credit card, the tuition fees will be debited retrospectively at the end of each month. Otherwise, students are obliged to transfer the tuition fees to IU in arrears at the end of each month. Tuition fees shall be paid for the first time after expiry of the withdrawal period. The graduation fee is due upon registration for the final examination (colloquium). It must either be transferred by the student to the IU within ten days of the due date or, if a SEPA direct debit mandate or authorisation to debit by credit card has been issued, it will be collected by IU. Without full payment of the graduation fee, the student cannot graduate. If the student wishes to take his:her final examination (colloquium) before the end of the agreed standard period of study, the tuition fees still outstanding until the regular end of the study programme must be paid in full before the date of the colloquium. Changes regarding the amount of tuition fees may result from discount promotions in effect at the time of registration.
3.4. Reduction of tuition fees through recognition of prior achievements
Upon application, prior knowledge and qualifications can be recognised within the framework of the study and examination regulations. This recognition may lead to a change in the duration of study and to a reduction in tuition fees. If the standard period of study is reduced due to the recognition of prior knowledge and qualifications within the framework of the study and examination regulations, the student will be informed of the changed standard period of study by a notification of recognition (Anerkennungsbescheid).
If the application for recognition of prior knowledge and qualifications is submitted before the start of the study programme as defined in Section 2.1. or within one month after the start of the study programme (end of trial month), the tuition fees per recognized ECTS credit are reduced as follows:
- For prior knowledge and qualifications acquired and recognised at IU International University of Applied Sciences in a completed programme, the total amount of tuition fees is reduced by a one-time EUR 90.00 per recognised ECTS credit for the standard period of study.
- For externally acquired and recognised prior knowledge and qualifications, the total amount of the tuition fees is reduced by a one-time EUR 30.00 per recognised ECTS credit for the standard period of study.
The number of instalments to be paid and/or the amount of the final instalment is reduced, the instalment amount on page 1 remains unchanged. In the case of an application for recognition of prior knowledge and qualifications after the trial month, no reduction in tuition fees will be made. The applicant will be informed of the number of ECTS credits recognised and the reduction in tuition fees by means of a notification of recognition (Anerkennungsbescheid).
3.5. Recognition of prior learning for professional online study programmes
For vocational online study programmes that require mandatory specific vocational training in the subject of the online study programme (e.g. Physiotherapie B.A., Ergotherapie B.Sc. and others), prior knowledge and qualifications are recognised within the framework of the study and examination regulations. The student may neither object to this blanket recognition nor take the courses recognised under this blanket recognition at IU International University of Applied Sciences.
This recognition leads to a change in the duration of studies, the duration of the contract and a reduction in tuition fees, which is already taken into account on page 1. In addition, 3.4. of the contractual provisions shall apply.
4. Student obligations
4.1. Payment of tuition fees
If the tuition fees are not paid by the due date, IU is entitled to charge the student for any fees incurred. Irrespective of this, IU is entitled to terminate the contract extraordinary without notice if the student is in arrears with the payment of tuition fees.
If the student decides to make an advance payment before the start of the studies, he:she is only entitled to the granting of an advance payment discount if the payment amount has been received in the IU account by the expiry of the withdrawal period.
4.2. Examinations
If the student has to repeat an examination because of attempted cheating or plagiarism, additional fees of EUR 300.00 will be charged for each examination to be repeated.
Within 24 months of taking the corresponding course, the student must complete the corresponding examination specified in the module handbook, but at least the first examination attempt. If the student does not complete this examination or the first examination attempt within 24 months of taking the course, all learning assessments completed up to that point are forfeited with the consequence that they must be completed again within twelve months and the course must be taken again at a charge.
4.3. Completion of course work by means of online tools
The completion of course work in certain modules or programmes can sometimes only be done through the use of online tools, which also require data processing outside the EU. The details on data processing are explained in separate information sheets.
The student is aware that in order to ensure the smooth running of online examinations, a knowledge of English to a small extent is necessary, as communication with the proctors (examination invigilators) is only possible in English.
4.4. Checking using plagiarism software
The student is obliged to provide an electronic version of his:her examination paper in a format that can be electronically copied and read (e.g. DOC, DOCX, PDF, RTF) free of all personal data (without cover sheet, personal declarations, dedications, signature, etc.) to enable the IU to check his:her examination paper using plagiarism software. The student grants the IU and third parties specifically commissioned by the IU the right to use the examination paper for this purpose.
4.5. Preservation of copyright
All study content and media are protected by copyright. Any use in cases other than those permitted by contract is not permitted and requires the prior written consent of the copyright holder. This applies in particular to making them publicly available via the Internet, copying them and passing them on to third parties. It is permitted to save and print out the study content and media for personal purposes.
4.6. Further obligations
The student acknowledges the currently valid General Examination Regulations as well as the Study and Examination Regulations (APO) for the study programme of IU International University of Applied Sciences named on page 1 of this contract, the IU Library Usage Regulations and the Guidelines for Online Examinations and Online Presentations as binding for him:herself.
4.7. Additional costs
For the implementation of some study programmes, the purchase of certain technical equipment or other materials and/or the participation in certain excursions by the student is necessary. The purchase of this equipment and materials and costs for excursions are not included in the tuition fees. The respective additional costs can be found on the IU website.
5. Virtual campus and digital learning material
Central learning processes in the study programme as well as the organisation of studies are internet-based via the virtual campus of IU International University of Applied Sciences. The provision of the necessary technical equipment is not included in the tuition fees. The student is solely responsible for providing technical study equipment (hardware and software) that meets the requirements of IU. The student is obliged to inform him:herself independently whether the online tools and other technologies used by IU which are necessary for the execution of this contract are available in his:her region. An overview of the necessary online tools and the required technical study equipment (software and hardware) are listed on the website (https://www.iu-fernstudium.de/en/advice-and-faq/faqs).
The virtual campus of IU International University of Applied Sciences is password protected. The access data is communicated to the student at the beginning of the study programme and he:she guarantees not to pass this data on to third parties and not to allow unauthorised third parties to access the virtual campus or the learning materials of the study programme.
6. Right of withdrawal
The student has the right to withdraw from this contract within one month without giving reasons. The withdrawal period is one month from the day on which the student receives access to the learning material. In order to exercise the right of withdrawal, the student must inform IU Internationale Hochschule GmbH of his:her decision to withdraw from this contract by means of a clear declaration (e.g. a letter sent by post or an e-mail). He:she may use the model withdrawal form [https://res.cloudinary.com/iugroup/image/upload/v1717503731/Widerrufsformular-FS-EN_iiywoe.pdf], which is made available to the student digitally in the Campus Management System, for this purpose, but it is not mandatory. To comply with the withdrawal period, it is sufficient that he:she sends the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.
IU grants the student one month, which is not charged, if the student decides not to continue the studies within the withdrawal period (“trial month”). If the student continues his:her studies and does not exercise his:her right of withdrawal, this first month shall be deemed to be a regular study period for which a fee is charged.
7. Data protection
The details of the processing of personal data and the rights of the student in this context are explained in the separate information letter on data protection, which is made available to students on the homepage of the IU distance learning programme. In order to implement the contract, IU uses software from various providers through which personal data is also processed outside the European Union.
8. Liability of IU
IU is liable for damages based on an intentional or grossly negligent breach of duty by one of its legal representatives or vicarious agents. Furthermore, IU is liable for damages resulting from injury to life, body or health that are based on an intentional or negligent breach of duty by one of its legal representatives or vicarious agents. Otherwise, liability for damages based on a simple or slightly negligent breach of duty or a simple or slightly negligent tortious act committed by a legal representative or vicarious agent is excluded, unless essential obligations are breached, compliance with which is required to achieve the purpose of the contract, or which arise from the justified use of special trust. In these exceptional cases, liability is limited to compensation for foreseeable damage.
9. Place of jurisdiction and final provisions
German law shall apply to all claims arising from and in connection with this contract. In the event that the student moves his:her residence or habitual abode outside the Federal Republic of Germany after conclusion of the contract or if his:her residence or habitual abode is unknown at the time the action is brought, the following is agreed: For all disputes arising from or in connection with this contract, the jurisdiction of the German court responsible for the registered office of IU is agreed.
IU does not participate in dispute resolution proceedings within the meaning of the Consumer Dispute Resolution Act (VSBG).
In accordance with the applicable recognition notice issued by the Free State of Thuringia, IU has provided a private guarantee to mitigate the risk of premature termination of academic operations. However, this does not constitute a guarantee that students will be able to complete their studies at IU International University of Applied Sciences, regardless of the financial situation of the sponsor. For legal reasons, IU points out that the Free State of Thuringia neither guarantees the continuation of studies nor will it grant financial assistance in the event of the cessation of studies.
There are no ancillary agreements to this contract. Amendments or supplements to this contract must be made in text form to be effective. The amendment or supplement to this provision itself shall also require text form. Should individual or several provisions of this contract be or become invalid, the validity of the remaining provisions shall remain unaffected. In the event of a loophole in this contract, a provision shall be found which otherwise corresponds to the meaning, purpose and economic content of the contract.

(2) If a Master’s Entrance Examination or a Master Qualifying Examination is required for admission, applicants are admitted in accordance with the Regulations for Access to Bachelor's and Master's Degree Programmes (OZBM) in conjunction with the AZE and, if applicable, begin their studies with the status of participant. Applicants are not enrolled until they have met all the necessary admission requirements and passed the required admission courses. The Master's Entrance Examination must be successfully passed within twelve months, otherwise this contract ends automatically after twelve months from registration for the Master’s Entrance Examination required in accordance with the OZBM without the need for termination. With regard to the Master Qualifying Examination ection 2.1. shall apply in derogation of this regulation. No ECTS- credits can be earned through examinations taken during the Master’s Entrance Examination but these will be fully recognised afterwards as part of the study programme.
(3) The regulations of this contract also apply to participants, even if the designation "student" is used. For participants and thus, also for the periods in which the participant does not yet have official student status, the respectively valid study and examination regulations of the underlying study programme apply.
1.4. Student status
Membership status at IU International University of Applied Sciences in the form of student status only commences once candidates
a) successfully fulfil all admission requirements for their chosen study programme, submit all necessary documents proving their university entrance qualification in accordance with the AZE in the required form, and
b) have proven that they are insured under the statutory health insurance scheme (gesetzliche Krankenversicherung) or will be insured at the start of their semester, at the earliest on the day of enrolment, or that they are not insured under the statutory health insurance scheme because they are exempt from insurance, exempt from compulsory insurance or not subject to compulsory insurance.
2. Contract term
2.1. Duration of the contract
The standard period of study related to the chosen study programme is based on the details on page 1 of this contract, and in the case of a postponement of the study start date, the standard period of study is based on the terms of the corresponding supplementary agreement. The agreed duration of study in the chosen time model on page 1 of this contract corresponds to the standard period of study for the chosen study programm.
This contract is generally concluded for an indefinite period of time.
The contract begins at the time specified on page 1 of this contract, unless otherwise agreed, but at the earliest upon receipt of the access data to the Campus Management System and upon fulfilment of the requirements set out in Section 1.3. and Section 1.4. of this contract. Fulfilment of the requirements under Section 1.4. a) of this contract is not a prerequisite for the start of the contract in cases where admission to the study programme is granted through the Master's entrance examination according to Section 1.3. (2) of this contract.
The contract ends after the agreed standard period of study without the need for termination, as long as the student provides all necessary proof of performance by this time. If the student does not provide all necessary proof of performance within the agreed standard period of study, this contract will be extended in accordance with the Section 2.2. of this contract.
If the participant is required to attend and pass extracurricular admissions courses, such as, but not limited to, admissions courses (Masters Qualifying Examination) or bridging courses in accordance with the OZBM, in order to obtain part or all of the university entrance qualification, the contract shall begin, in deviation from what was previously agreed, on the date stated on page 1, unless otherwise agreed, but no earlier than the date notified to the pParticipant in the confirmation of admission to the study programme: the participant will be informed of this in the IU's confirmation of admission to the study programme.
The participant will receive the confirmation of admission to the studies within fourteen days from the date of notification of passing the relevant extracurricular admission courses in the Campus Management System. The exact start date of this contract will be communicated to the participant in the letter confirming admission to the study programme and will be within fourteen days of the announcement of passing the relevant extracurricular admission courses, unless a later start date has been chosen.
2.2. Contract extension due to lack of performance records
If the student does not provide all the necessary proof of performance within the agreed standard period of study, the contract is automatically extended free of charge for a maximum of twelve months. If the assumed standard period of study is reduced due to the recognition of prior achievements and qualifications within the framework of the study and examination regulations, the contract is automatically extended free of charge by a maximum of twelve months from the premature termination date of the standard period of study due to the reduction. During this period, all services can continue to be used and examination services can be provided without incurring further costs, provided that the monthly instalments payable in accordance with page 1 have already been paid in full at this time.
If the student does not provide all necessary proof of performance within the free contract extension, the contract will be automatically extended for an indefinite period of time at a charge following the free extension. For the fee-based extension of the duration of the contract in accordance with this Section, the tuition fees applicable at that time must be paid in return for the continued use of IU’s facilities and services.
IU reserves the right to adjust (increase or decrease) the tuition fees to the then current tuition fee level in the event of an extension following the agreed standard period of study and the free extension period. In the event of a fee-based extension of the term, the tuition fees that were valid at the time of commencement of studies will not automatically be applied. IU will inform the student in advance in text form about the fees to be paid during the fee-based extension.
2.3. Ordinary termination of the contract
Until the end of the first five months the contract can be terminated with a notice period of one month to the end of a full month in relation to the beginning of the contract.
After the end of the first five months, the contract may be terminated at any time with three months' notice to the end of a full month in relation to the beginning of the contract.
During the free of charge and fee-based extension according to Section 2.2. after expiration of the standard period of study according to Sections 2.1./2.2. the contract can be terminated at any time with a notice period of one month.
Notice of termination must be given in text form (e.g. by termination in the Campus Management System, termination by form on the IU Website or by e-mail).
In the event of termination, the student will generally be de-registered at the time this contract ends. At the request of the student, which must be made in text form, de-registration shall take place before the end of this contract. In the event of de-registration before the end of this contract, the student is obliged to pay a monthly contract fee equal to the agreed tuition fees until the end of this contract.
2.4. Extraordinary termination of the contract
The right to extraordinary termination for good cause remains unaffected. Important reasons on the part of the student entitling him:her to extraordinary termination exist, in particular, in the event of appropriately proven unexpected occurrence of unemployment, life-threatening illnesses and the death of the student. A change of study programme, relocation, failed exams, financial or family reasons do not generally justify extraordinary termination.
If the admission to the study programme lapses, is revoked or withdrawn after conclusion of the contract, the student may terminate the contract within two weeks without observing a notice period.
On the part of IU, important reasons entitling the IU to extraordinary termination may exist, in particular, in case of tuition fees not paid on time, violations of the study and examination regulations of IU International University of Applied Sciences, in case of criminal acts of the student to the detriment of IU, or if it is foreseeable that a necessary (re)accreditation or approval of a study programme will not be granted.
2.5. Leave of absence
In cases of illness or other proven personal reasons that prevent the student from continuing with their studies, the student may apply for a leave of absence for a period of six months. In principle, a leave of absence can be granted at the earliest at the start of the second semester, i.e. six months after the start of studies.
The mutual rights and obligations of the contract shall be suspended for the period of the leave of absence. The obligation to pay the entire tuition fees according to Section 3. shall remain in force even if the student is on leave of absence. If the student is granted a leave of absence for a period of six months, the monthly instalments stipulated on page 1 of this contract shall be paid over and above the standard period of study agreed on page 1 until the total sum of the monthly instalments payable under page 1 has been paid in full.
The application for a leave of absence for a period of six months must be made in text form no later than two weeks before the desired start date at the start of a full month in relation to the start date of the contract. The study contract cannot be terminated during the period of a leave of absence that has been granted. When applying for a leave of absence, the "Leaflet on Leave of Absence" and/or the "Leaflet on Leave of Absence due to Maternity and/or Paternity Leave" will become part of this contract.
Persons who only have participant status in accordance with Section 1.3. (2) cannot apply for a leave of absence.
2.6. Failure to pass necessary examinations
In the event that the student ultimately fails an examination required for the successful completion of the study programme, the contract shall end without the need for termination with completion of his:her personal semester, in which the final failure was achieved. In this case, the student will be de-registered at the end of his:her personal semester in which the final failure was achieved. At the request of the student, which must be made in text form, de-registration shall take place before the termination of this contract. In such cases, the contract shall end upon receipt of the request for de-registration by IU International University of Applied Sciences.
2.7. Other reasons for termination due to de-registration by IU International University of Applied Sciences
If the student's enrolment at IU International University of Applied Sciences is terminated in accordance with the reasons for de-registration specified by the AZE, this contract shall end upon de-registration without the need for termination. This provision shall only apply insofar as this contract does not provide for any deviating provisions and none of the cases specified in Sections 2.4. or 2.6. of this contract apply.
3. Tuition fees
3.1. Cost models per time variant
The total cost of the chosen study programme depends on the chosen time model. In the event of a change of time model during the study programme, the tuition fees applicable to the new time model at the time of application will be taken as a basis.
3.2. Tuition fees for the study programme
The total costs for the chosen study programme related to the standard period of study are stated on page 1 of this contract and are payable in full regardless of the actual period time spent in the study programme upon successful completion of the study programme within the standard period of study or before, unless the contract is terminated prematurely without successful completion of the study programme.
3.3. Method of payment and payment deadline
Tuition fees are payable monthly and are due in arrears at the end of each month. With an existing SEPA direct debit mandate or authorisation to collect fees by credit card, the tuition fees will be debited retrospectively at the end of each month. Otherwise, students are obliged to transfer the tuition fees to IU in arrears at the end of each month. Tuition fees shall be paid for the first time after expiry of the withdrawal period. The graduation fee is due upon registration for the final examination (colloquium). It must either be transferred by the student to the IU within ten days of the due date or, if a SEPA direct debit mandate or authoriszation to debit by credit card has been issued, it will be collected by IU. Without full payment of the graduation fee, the student cannot graduate. If the student wishes to take his:her final examination (colloquium) before the end of the standard period of study the tuition fees still outstanding until the regular end of the study programme must be paid in full before the date of the colloquium. Changes regarding the amount of tuition fees may result from discount promotions in effect at the time of registration.
3.4. Reduction of tuition fees through recognition of prior achievements
Upon application, prior knowledge and qualifications can be recognised within the framework of the study and examination regulations. This recognition may lead to a change in the duration of study and to a reduction in tuition fees. If the standard period of study is reduced due to the recognition of prior knowledge and qualifications within the framework of the study and examination regulations, the student will be informed of the changed standard period of study by a notification of recognition (Anerkennungsbescheid).
If the application for recognition of prior knowledge and qualifications is submitted before the start of the study programme as specified in Section 2.1. or within one month after the start of the study programme (end of trial month), the tuition fees per recognised ECTS credit are reduced as follows:
- For prior knowledge and qualifications acquired and recognised at IU International University of Applied Sciences in a completed programme, the total amount of tuition fees is reduced by a one-time EUR 90.00 per recognised ECTS credit for the standard period of study.
- For externally acquired and recognised prior knowledge and qualifications, the total amount of the tuition fees is reduced by a one-time EUR 30.00 per recognised ECTS credit for the standard period of study.
The number of instalments to be paid and/or the amount of the final instalment is reduced, the instalment amount on page 1 remains unchanged. In the case of an application for recognition of prior knowledge and qualifications after the trial month, no reduction in tuition fees will be made. The applicant will be informed of the number of ECTS credits recognised and the reduction in tuition fees by means of a notification of recognition (Anerkennungsbescheid).
4. Student obligations
4.1. Payment of tuition fees
If the tuition fees are not paid by the due date, IU is entitled to charge the student for any fees incurred. Irrespective of this, IU is entitled to terminate the contract extraordinary without notice if the student is in arrears with the payment of tuition fees.
If the student decides to make an advance payment before the start of the studies, he:she is only entitled to the granting of an advance payment discount if the payment amount has been received in the IU account by the expiry of the withdrawal period.
4.2. Examinations
If the student has to repeat an examination because of attempted cheating or plagiarism, additional fees of EUR 300.00 will be charged for each examination to be repeated.
Within 24 months of taking the corresponding course, the student must complete the corresponding examination specified in the module handbook, but at least the first examination attempt. If the student does not complete this examination or the first examination attempt within 24 months of taking the course, all learning assessments completed up to that point are forfeited with the consequence that they must be completed again within twelve months and the course must be taken again at a charge.
4.3. Completion of coursework by means of online tools
The completion of course work in certain modules or programmes can sometimes only be done through the use of online tools, which also require data processing outside the EU. The details on data processing are explained in separate information sheets.
The student is aware that in order to ensure the smooth running of online examinations, a knowledge of English to a small extent is necessary, as communication with the proctors (examination invigilators) is only possible in English.
4.4. Checking using plagiarism software
The student is obliged to provide an electronic version of his:her examination paper in a format that can be electronically copied and read (e.g. DOC, DOCX, PDF, RTF) free of all personal data (without cover sheet, personal declarations, dedications, signature, etc.) to enable the IU to check his:her examination paper using plagiarism software. The student grants the IU and third parties specifically commissioned by the IU the right to use the examination paper for this purpose.
4.5. Preservation of copyright
All study content and media are protected by copyright. Any use in cases other than those permitted by contract is not permitted and requires the prior written consent of the copyright holder. This applies in particular to making them publicly available via the Internet, copying them and passing them on to third parties. It is permitted to save and print out the study content and media for personal purposes.
4.6. Further obligations
The student acknowledges the currently valid General Examination Regulations as well as the Study and Examination Regulations (APO) for the study programme of IU International University of Applied Sciences named on page 1 of this contract, the IU Library Usage Regulations and the Guidelines for Online Examinations and Online Presentations as binding for him:herself.
4.7. Additional costs
For the implementation of some study programmes, the purchase of certain technical equipment or other materials and/or participation in certain excursions by the student is necessary. The purchase of this equipment and materials and costs for excursions are not included in the tuition fees. The respective additional costs can be found on the IU website.
5. Virtual campus and digital learning material
Central learning processes in the study programme as well as the organisation of studies are internet-based via the virtual campus of IU International University of Applied Sciences. The provision of the necessary technical equipment is not included in the tuition fees. The student is solely responsible for providing technical study equipment (hardware and software) that meets the requirements of IU. The student is obliged to inform him:herself independently whether the online tools and other technologies used by IU, which are necessary for the execution of this contract, are available in his:her region. An overview of the necessary online tools and the required technical study equipment (software and hardware) are listed on the website (https://www.iu-fernstudium.de/en/advice-and-faq/faqs).
The virtual campus of the IU International University of Applied Sciences is password -protected. The access data is communicated to the student at the beginning of the study programme and he:she guarantees not to pass this data on to third parties and not to allow unauthorised third parties to access the virtual campus or the learning materials of the study programme.
6. Right of withdrawal
The student has the right to withdraw from this contract within one month without giving reasons. The withdrawal period is one month from the day on which the student receives access to the learning material. In order to exercise the right of withdrawal, the student must inform IU Internationale Hochschule GmbH of his:her decision to withdraw from this contract by means of a clear declaration (e.g. a letter sent by post or an e-mail). He:she may use the model withdrawal form [https://res.cloudinary.com/iugroup/image/upload/v1717503731/Widerrufsformular-FS-EN_iiywoe.pdf], which is made available to the student digitally in the Campus Management System, for this purpose, but it is not mandatory. To comply with the withdrawal period, it is sufficient that he:she sends the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.
IU grants the student one month, which is not charged, if the student decides not to continue the studies within the withdrawal period (“trial month”). If the student continues his:her studies and does not exercise his:her right of withdrawal, this first month shall be deemed to be a regular study period for which a fee is charged.
7. Data protection
The details of the processing of personal data and the rights of the student in this context are explained in the separate information letter on data protection, which is made available to students on the homepage of the IU distance learning programme. In order to implement the contract, IU uses software from various providers through which personal data is also processed outside the European Union.
8. Liability of IU
IU is liable for damages based on an intentional or grossly negligent breach of duty by one of its legal representatives or vicarious agents. Furthermore, IU is liable for damages resulting from injury to life, body or health that are based on an intentional or negligent breach of duty by one of its legal representatives or vicarious agents. Otherwise, liability for damages based on a simple or slightly negligent breach of duty or a simple or slightly negligent tortious act committed by a legal representative or vicarious agent is excluded, unless essential obligations are breached, compliance with which is required to achieve the purpose of the contract, or which arise from the justified use of special trust. In these exceptional cases, liability is limited to compensation for foreseeable damage.
9. Place of jurisdiction and final provisions
German law shall apply to all claims arising from and in connection with this contract. In the event that the student moves his:her residence or habitual abode outside the Federal Republic of Germany after conclusion of the contract or if his:her residence or habitual abode is unknown at the time the action is brought, the following is agreed: For all disputes arising from or in connection with this contract, the jurisdiction of the German court responsible for the registered office of IU is agreed.
IU does not participate in dispute resolution proceedings within the meaning of the Consumer Dispute Resolution Act (VSBG).
In accordance with the applicable recognition notice issued by the Free State of Thuringia, IU has provided a private guarantee to mitigate the risk of premature termination of academic operations. However, this does not constitute a guarantee that students will be able to complete their studies at IU International University of Applied Sciences, regardless of the financial situation of the sponsor. For legal reasons, IU points out that the Free State of Thuringia neither guarantees the continuation of studies nor will it grant financial assistance in the event of the cessation of studies.
There are no ancillary agreements to this contract. Amendments or supplements to this contract must be made in text form to be effective. The amendment or supplement to this provision itself shall also require text form. Should individual or several provisions of this contract be or become invalid, the validity of the remaining provisions shall remain unaffected. In the event of a loophole in this contract, a provision shall be found which otherwise corresponds to the meaning, purpose and economic content of the contract.
General Terms and Conditions further education programmes
1. Conduct of the programme
1.1. Programme name and title after graduation
IU Internationale Hochschule GmbH (hereinafter referred to as: IU), the sponsor of IU International University of Applied Sciences, undertakes to implement the distance learning programme (hereinafter: programme) at IU International University of Applied Sciences mentioned on page 1 of the distance learning contract (hereinafter: contract) in accordance with the respective valid study and examination regulations of the underlying study programme of IU International University of Applied Sciences accredited as a distance learning study programme. The contract is concluded with the electronic confirmation of acceptance by IU.
Upon successful completion of the programme, the participant will receive a certificate for the programme specified on page 1 of this contract. The content of the courses offered, as well as the period of time allocated for each of them, result from the module handbook with curriculum, which is made available to the participant in a suitable form.
IU points out that in the case of newly introduced programmes or newly introduced source study programmes on which the programmes are based, there may be a restriction on the availability of programme content from higher subject semesters of the underlying source study programme. Likewise, in the case of newly introduced programmes or newly introduced source study programmes on which the programmes are based, the free choice regarding the sequence of the programme content cannot always be guaranteed. Notwithstanding this, IU ensures that the content of the relevant programme can be completed within the agreed programme period.
Furthermore, it is pointed out that certain programmes have compulsory presence and practice parts and that these programmes can therefore not take place exclusively within the framework of distance learning. Further information on this can be found in the respective valid module handbooks of the underlying source study programme and are specified in the respective practice module-related examination guidelines.
1.2. Amendment of programme schedules
IU has the right to amend programme plans insofar as this is reasonable for the participant and in accordance with the educational objective of the programme.
1.3. Admission to the programme
The admission to the programme is subject to the condition that the participant has a university entrance qualification or a completed vocational education. The prerequisite for the fulfilment of the university entrance qualification at IU International University of Applied Sciences is that the participant has the general university entrance qualification, the subject-related university entrance qualification or the advanced technical college entrance qualification, a university entrance qualification recognised as equivalent by the responsible state authorities or a corresponding professional qualification. For participants, the valid study and examination regulations of the underlying study programme apply accordingly.
1.4. No student status
Participants do not acquire student status, even if they successfully meet all admission requirements and have provided proof of this in the required form.
2. Contract term

The regular programme period related to the selected programme is based on the details on page 1 of this contract, and in the case of a postponement of the programme start, the regular programme period is based on the terms of the corresponding supplementary agreement ("agreed programme period").

Changes regarding the amount of the programme fees may result from discount promotions at the time of registration.

All programme content and media are protected by copyright. Any use in cases other than those permitted by contract is not permitted and requires the prior written consent of the copyright holder. This applies in particular to making them publicly available via the Internet, copying them and passing them on to third parties. It is permitted to save and print out the programme content and media for personal purposes.
4.6. Further obligations
The participant acknowledges the currently valid General Examination Regulations (APO) as well as the Study and Examination Regulations of the source study programme of IU International University of Applied Sciences, the IU Library Usage Regulations and the Guidelines for Online Examinations and for Online Presentations as binding for him:herself.
4.7. Additional costs
For the implementation of some programmes, the purchase of certain technical equipment or other materials and/or participation in certain excursions by the participant is necessary. The purchase of this equipment and materials and costs for excursions are not included in the programme fees. The respective additional costs can be found on the IU website.
5. Virtual campus and digital learning material
Central learning processes in the programme as well as the programme organisation are internet-based via the virtual campus of IU International University of Applied Sciences. The provision of the necessary technical equipment is not included in the programme fees. The participant is solely responsible for providing technical equipment (hardware and software) that meets the requirements of IU. The participant is obligated to inform him:herself independently whether the online tools and other technologies used by IU which are necessary for the execution of this contract are available in his:her region. An overview of the necessary online tools and the required technical equipment (software and hardware) are listed on the website (https://www.iu-fernstudium.de/en/advice-and-faq/faqs/).
The virtual campus of IU International University of Applied Sciences is password protected. The access data will be communicated to the participant at the beginning of the programme and he:she assures not to pass these data on to third parties and not to allow unauthorised third parties to access the virtual campus or the learning materials of the programme.
6. Right of withdrawal
The participant has the right to withdraw from this contract within one month without giving reasons. The withdrawal period is one month from the day on which the participant receives access to the learning material. In order to exercise the right of withdrawal, the participant must inform IU Internationale Hochschule GmbH of his:her decision to withdraw from this contract by means of a clear declaration (e.g. a letter sent by post or an e-mail). He:she may use the model withdrawal form [https://res.cloudinary.com/iugroup/image/upload/v1717503731/Widerrufsformular-FS-EN_iiywoe.pdf], which is made available to the participant digitally in the Campus Management System, for this purpose, but it is not mandatory. To comply with the withdrawal period, it is sufficient that he:she sends the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.
IU grants the participant one month, which is not charged, if the participant decides not to continue the programme within the withdrawal period (“trial month”). If the participant continues his:her programme and does not exercise his:her right of withdrawal, this first month shall be deemed to be a regular programme period for which a fee is charged.
7. Data protection
The details of the processing of personal data and the rights of the participant in this context are explained in the separate information letter on data protection, which is made available to participants on the homepage of the IU distance learning programme. In order to implement the contract, IU uses software from various providers through which personal data is also processed outside the European Union.
8. Liability of IU
IU is liable for damages based on an intentional or grossly negligent breach of duty by one of its legal representatives or vicarious agents. Furthermore, IU is liable for damages resulting from injury to life, body or health that are based on an intentional or negligent breach of duty by one of its legal representatives or vicarious agents. Otherwise, liability for damages based on a simple or slightly negligent breach of duty or a simple or slightly negligent tortious act committed by a legal representative or vicarious agent is excluded, unless essential obligations are breached, compliance with which is required to achieve the purpose of the contract, or which arise from the justified use of special trust. In these exceptional cases, liability is limited to compensation for foreseeable damage.
9. Place of jurisdiction and final provisions
German law shall apply to all claims arising from and in connection with this contract. In the event that the participant moves his:her residence or habitual abode outside the Federal Republic of Germany after conclusion of the contract or if his:her residence or habitual abode is unknown at the time the action is brought, the following is agreed: For all disputes arising from or in connection with this contract, the jurisdiction of the German court responsible for the registered office of IU is agreed.
IU does not participate in any dispute resolution proceedings within the meaning of the Consumer Dispute Resolution Act (VSBG).
In accordance with the applicable recognition notice issued by the Free State of Thuringia, IU has provided a private guarantee to mitigate the risk of premature termination of academic operations. However, this does not constitute a guarantee that students will be able to complete their studies at IU International University of Applied Sciences, regardless of the financial situation of the sponsor. For legal reasons, IU points out that the Free State of Thuringia neither guarantees the continuation of studies nor will it grant financial assistance in the event of the cessation of studies.
There are no ancillary agreements to this contract. Amendments or supplements to this contract must be made in text form to be effective. The amendment or addition to this provision itself shall also require text form. Should one or more provisions of this contract be or become invalid, this shall not affect the validity of the remaining provisions. In the event of a loophole in this contract, a provision shall be found which otherwise corresponds to the meaning, purpose and economic content of the contract.
